Journalisten ausländischer Medien haben der "Sunday Times" zufolge Zeugen im Pistorius-Prozess drangsaliert. Reporter hätten versucht, im Kreis von Angehörigen und Freunden der Zeugen "schmutzige Wäsche" auszugraben, zitierte die Zeitung einen Polizeioffizier. Mehrere Zeugen der Anklage, unter ihnen Polizisten, haben sich demnach über solche Belästigungen bei der Staatsanwaltschaft beschwert.

Journalisten ausländischer Medien hätten versucht, im Kreis von Angehörigen und Freunden der Zeugen "schmutzige Wäsche" auszugraben, sagte ein Polizeioffizier laut des Berichtes. Einigen Zeugen soll damit gedroht worden sein, dass Details über ihr Privatleben oder Mitschnitte von Telefongesprächen veröffentlicht werden könnten. Mehrere Zeugen der Anklage, unter ihnen auch Polizisten, hätten sich über solche Belästigungen beschwert.

Am Montag wird Staatsanwalt Gerrie Nel die Anklage vortragen. Pistorius, der sich bisher als Opfer eines "entsetzlichen Irrtums" dargestellt hat, wird sich als "schuldig" oder "nicht schuldig" bekennen müssen. Danach beginnt die Zeugenvernehmung: Geladen sind allein von der Anklagebehörde 107 Polizisten, Forensiker und andere Experten sowie Nachbarn und Personen aus dem persönlichen Umfeld von Pistorius und des Opfers. Der Prozess ist zunächst auf 15 Verhandlungstage angesetzt.

Pistorius's statement


"During the early hours of the morning I brought two fans in from the balcony," Mr Pistorius said in his statement.

"I had shortly before spoken to Reeva who was in bed beside me.


"Unbeknown to me, Reeva must have gone to the toilet in the bathroom at the time I brought in the fans, closed the sliding doors and drew the blinds and the curtains.


"I heard the bathroom window sliding open, I believed that an intruder or intruders had entered the bathroom through the bathroom window which was not fitted with burglar bars.


"I approached the bathroom armed with my firearm, so as to defend Reeva and I . At that time I believed Reeva was still in the bed.


"The discharging of my firearm was precipitated by a noise in the toilet which I, in my fearful state, knowing I was on my stumps, unable to run away or properly defend my self physically believed to be the intruder or intruders coming out of the toilet to attack Reeva and me.


"I respectfully believe the state has no basis for alleging that I wanted to take Reeva's life."



Screams heard


The first witness at the trial was Michell Burger, who lives in the Silver Stream Estate, about 177m (195ft) from Mr Pistorius's house in a separate gated community, the Silverwoods Country Estate.


She said she woke after 3am on 14 February 2013 to the sound of a woman's screams.


"I sat upright in bed," she said."My husband also woke up from the screams. My husband jumped up and went to the balcony. I was still sitting in the bed and I heard her screams. She screamed terribly and she yelled for help. Then I also heard a man screaming for help."


Ms Burger, speaking in Afrikaans through an interpreter, said she then heard the gunshots.


"Just after her screams, I heard four shots. Four gunshots. Bang, bang, bang, bang," she said. "It was very traumatic for me. You could hear that it was bloodcurdling screams."

Für die nächsten Angehörigen muss es durch diese Zeugenaussagen unvorstellbar schwer sein, wenn sie die letzten Minuten des Lebens ihrer Reeva so klar und deutlich  vor Augen bekommen.
 
Und es  wird schwer für Pistorius die Richterin von der Version eines Einbrechers  zu überzeugen. 
Mal gucken, wie der Prozess weiter verläuft. 

Wenn Reeva nachts mit dem Handy aufs Klo läuft, fällt mir dafür als einzige Erklärung ein, dass sie sich dorthin zu retten versucht hat und telefonieren wollte. Aber dann stellt sich für mich die  Frage, warum sie nicht gleich aus dem Haus gerannt ist? War die Haustür verschlossen, so dass sie nicht hinaus  konnte?

Estelle van der Merwe berichtete am Dienstag sichtlich nervös und offenbar ängstlich über die Geräusche aus dem Haus von Pistorius. Ein lautstarker Streit dort habe über eine Stunde gedauert.

Auch der dritte Zeuge der Anklage, der Ehemann der ersten Zeugin Michelle Burger ( Charl Johnson ) , stellte mit seiner Aussage die Darstellungen von Pistorius infrage. Der hatte stets behauptet, die tödlichen Schüsse auf seine Freundin Reeva Steenkamp seien ein „tragischer Unfall“ gewesen.

WITNESS TESTIMONY, DAY 2

Witness #2: Estelle Van Der Merwe, another neighbour of Oscar Pistorius. Van Der Merwe is delivering her testimony in Afrikaans.

Ms Van Der Merwe says she went to bed at about 21:00 and she woke up at about 1:56. "It seemed like somebody was involved in a fight," she says. "People were talking in loud voices." She adds it lasted about an hour but she couldn't hear what they were saying.

The witness says she was irritated by the noise. " placed a pillow on my head in hope of falling asleep again," she adds.

The witness tells the court she heard four sounds but that she did not know how to describe them. "It sounded like 'bang, bang'... that's the best I can do," she says

Ms Van Der Merwe is shown an aerial photograph of the area and is asked to identify which house is hers. The house is across the street and one house to the right of Mr Pistorius' property, the court hears.

Witness says she "heard male voices - sounded like they were involved in a fight. I saw lights at Oscar's house."

Roux on cross:

Mr Roux returns to the subject of what Ms Van Der Merwe heard on the night of 14 February 2013. The witness earlier said she heard an argument and later "four sounds... that sounded like 'bang, bang'" but Mr Roux tells the court she is mistaken. That she did not hear any argument, only a woman's voice.

The witness says she can't recall every detail of the incident clearly. "I was terribly frightened," she adds, and then goes on to describe how she saw an ambulance outside Mr Pistorius's house.

Witness #3: Charl Peter Johnson.

Mr Johnson is Michelle Burger's husband.

Mr Johnson says he would prefer to testify in English. He is repeatedly asked to speak more loudly by the judge.

The witness says he was woken by screams on the night of Ms Steenkamp's death. "When I heard the lady scream again I jumped out of bed and ran to the balcony which is on the first floor," he says.

Mr Pistorius and Mr Johnson know each other and have chatted a few times, the court hears. The witness points out his house in an aerial shot.

Mr Johnson tells the court what he heard: "I could hear she was in trouble, it was clearly distress calls." He says he stood on the balcony listening for what felt like a few minutes. He added he also heard a lady scream for help, followed by a male voice shouting more than once, and possibly three times - "Help, help, help".

Mr Johnson says the shots he heard prompted him to look into tighter security measures for his home. He says he was, at the time, convinced it was a housebreak.

Mr Johnson says he was told by a friend the next day that Mr Pistorius had shot his girlfriend. "I was surprised... It was difficult to relate this to what I had heard."

The witness says he felt "morally obliged" to speak to police about his version of events after it was reported that just one person was heard screaming. "We didn't want to get involved - we wanted to remain out of the public knowing what the interest would be worldwide in this case," he adds.

Mr Johnson tells the court he was not present while his wife made her police statement, nor was she present when he made his. They gave their statements to two police officers about a week after the incident.

The court session has finished for the day.

The trial will resume at 9:30 local time on Wednesday.

Pretoria - Am dritten Tag des Mordprozesses gegen den südafrikanischen Athleten Oscar Pistorius hat ein weiterer Zeuge seine Aussagen über Schreie im Haus des Angeklagten bekräftigt.
Wie schon zwei andere Zeugen zuvor berichtete auch Charl Johnson im Gericht von Pretoria von lauten Hilfe-Rufen vor den Schüssen in der Tatnacht.

Mr Roux sought to undermine the prosecution testimony of a couple who say they heard a woman's screams and gunfire the night that Pistorius killed Steenkamp. Telephone records will show that the banging sounds the neighbors heard were not gunshots but a distressed Pistorius breaking down the toilet door with a cricket bat after realising he had shot Steenkamp when she was in the toilet, thinking it was an intruder, Mr Roux asserted.

Throwing doubt on the witnesses' recollection of the sequence in the early hours is crucial for Pistorius' defence after the state maintained there was a loud argument on the night he shot Steenkamp through a door in his bathroom and the screams and shouts were before a gun was fired.

Pistorius' team wants to show the screams were Pistorius calling for help after the accidental killing and before he used the bat on the door.

Charl Johnson and his wife Michelle Burger have testified to hearing a woman screaming, a man shouting for help and then gunshots. During his cross-examination of Mr Johnson, Mr Roux said call records will show Pistorius called an estate manager at around 3:19am and soon after he bashed in the door with the bat.

In Mr Johnson and Ms Burger's testimony, they say they heard what they described as shots straight after making a call to security at 3:16am. The similar times show the sounds were the bat on the door, Mr Roux argued.

"There is only one thing you could have heard, because it coincides precisely,'" Mr Roux said to Mr Johnson. "That was the time that he [Pistorius] broke down the door [with the bat].'"

Mr Johnson replied: "I am convinced the sound I heard was gunshots."

Pretoria. Im Mordprozess gegen Oscar Pistorius hat die Verteidigung am Mittwoch die Wahrhaftigkeit der Aussagen zweier Zeugen in dem Fall angezweifelt.

Pistorius' Anwalt Barry Roux sagte, es gebe Unterschiede zwischen den Erklärungen, die die Eheleute Charl Johnson und Michelle Burger der Polizei gegeben hätten und den Angaben, die sie vor Gericht gemacht hätten. Johnson und Burger hatten vor dem Gericht in Pretoria ausgesagt, sie hätten in der Nacht, in der Pistorius seine Freundin erschoss, Schreie und Schüsse gehört.


Roux sagte, die Aussagen der Eheleute vor Polizei und Gericht wiesen Ähnlichkeiten auf. Er deutete an, dass Johnson und Burger Beweise verfälscht hätten, indem sie ihre Erklärungen abgesprochen hätten. "Sie hätten genauso gut zusammen im Zeugenstand stehen können", sagte er an die Adresse des Paars. "Was sagen Sie dazu?" Daraufhin wandte sich Richterin Thokozile Masipa an Roux und erklärte, er sei zu weit gegangen.

Johnson, ein Nachbar von Pistorius, setzte am Mittwoch seine Zeugenaussage in dem Prozess fort. Vor Gericht in der südafrikanischen Hauptstadt erklärte er, er habe in etwa zu der Zeit, als Pistorius in der Nacht zum 14. Februar 2013 seine Freundin Reeva Steenkamp erschossen haben soll, die Schreie einer verängstigten Frau und Schüsse gehört. Johnsons Frau Burger hatte eine ähnliche Aussage vor Gericht gemacht. An einer Stelle war sie in Tränen ausgebrochen, weil sie sich, wie sie angab, an die Schreie einer Frau erinnerte.

Roux argumentierte, wesentliche Elemente der Zeugenaussagen von Johnson und Burger hätten in ihren vorherigen Erklärungen gefehlt. So hätten sie unter anderem angegeben, dass sie gehört hätten, wie die Schreie einer Frau an Intensität zugenommen hätten und dass die weibliche Stimme nach dem letzten der abgegebenen Schüsse verklungen sei.

Ok, here are some questions for those of you who do not believe that the the witnesses have contradicted each other and believe that these witnesses have successfully discredited Oscar's statements:


1. When did Oscar scream "help, help, help" - before the shots were fired or after?

Based on witness testimony, I believe he yelled out help before the gunshots, possibly mocking Reeva. It's interesting to me that Ms. Burger had considered that possibility, as there had been a few of us here on this forum, including myself, who had entertained the same notion (I believe it was whiterum who first posted about it prior to Ms. Burger stating so in court the following day).

2. Who screamed after the shots were fired, Oscar or Reeva?

At least two posters (IIRC, they were Shane and Interested Bystander) have posted information regarding bullets and the sound barrier. Apparently, the sound of a gunshot travels at a faster rate of speed than the human voice. I think it's entirely possible that what was described as the "fading" of Reeva's final scream following the 4th gunshot was due to this phenomenon.

3. On the night of the shooting, did the husband and wife hear a woman's screams that sounded fearful and like her life was in danger? Or did they hear a confrontation that made them believe a house intrusion was happening and the husband was shot in front of the wife?

I think both these possibilities crossed their minds as events unfolded that night. Since they could only hear (and not see) what was going on, their minds went to what were logical scenarios.

4. Was Burger awoken by a woman's screams or by her husband jumping out of bed when he heard screams or gunshots?

Ms. Burger testified that she was awakened by screaming. Mr. Johnson testified that he jumped out of bed when he heard the screams. I don't believe he could know with precise certainty when his wife woke up or what caused her to be startled awake as he does not reside in her mind or body. Only Ms. Burger can attest to that and she affirms it was the screams that awoke her.

5. Did Burger and Johnson discuss their statements and testimony or did they not?

I believe over the course of this past year, they have talked to one another regarding what happened on that fateful night. I don't believe they collaborated to arrive at similar versions, as Roux would like the Judge to believe. I think it's perfectly natural for two people who live together & have been together for a number of years to share a similar vocabulary. I believe they are credible witnesses who testified as to what they each individually heard and pondered on the night of the shooting.

I've just started watching this trial. Although the idiot and harassing defense "lawyer" is aggressive, the female witness is holding her own....and may I say she sounds certain, educated and professional. The defense on the other hand sounds bungling and frustrated. Score 1 for female witness and zero for the defense attorney. You get more flies with honey then you do with vinegar....perhaps this defense attorney needs to go back to law school. As a witness, I would be playing with him just for fun!

PS.....the world is looking at him as a bully and not a skilled defense attorney......he will go the way of Alyce Laviolette I'm certain of it!
